Educational Service District 123 Non-Discrimination Policy

Community Policy and Notice of Discrimination

Educational Service District 123 complies with Federal civil rights laws and is committed to providing its programs and services without discrimination in accordance with:
  • Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, or national origin (including language);
  • Title IX of the Education Amendments of 1972 (Title IX), which prohibits discrimination on the basis of sex in any education or training program receiving federal financial assistance, with a limited number of defined exceptions;
  • Section 504 of the Rehabilitation Act of 1973 (Section 504), which forbids discrimination on the basis of an individual's disability by all federal agencies and in all federally funded activities;
  • The Age Discrimination Act of 1975, as amended, which prohibits discrimination in federally supported activities on the basis of age.

ESD 123 will take reasonable measures to provide access to programs and services to individuals with limited ability to speak, write, or understand English and/or to those with disabilities.


Community Complaint Process

Any person who believes that ESD 123 has failed to make reasonable accommodation for their disability, provide services, or discriminated in another way based on race, color, national origin (including language), disability, sex, age, or religion may file a written compliant with the ESD 123 Compliance Officer within 180 days of the allegation. 

The complaint must include (1) the nature of the complaint; (2) the facts upon which the complaint is based including dates; (3) requested action, and (4) the complainant’s contact information, signature as applicable, and the date the complaint is filed. The complaint can be filed in person, through the Online Tip Reporting System, or by mail, fax, or email with: Kaylee Bolt, Director of Human Resources.

Once a complaint is received, the Compliance Officer will review the complaint and may solicit additional information from the complainant as needed. If additional information is requested and not received, the case may be closed. The case may also be closed if the complainant no longer wishes to pursue their case. 

When an informal resolution is not possible, ESD 123 will investigate the allegations contained in the complaint in an effort to reach a prompt and equitable resolution. ESD’s goal is to address complaints within 60 days of receipt, though the time to carefully investigate complaints may be longer depending on the nature of the complaint and complexity of the issue. The complainant will be notified in writing of the results of the investigation and what actions will or have been taken in response and a timeline to request review.

Retaliation 

Retaliation (intimidation, threatening, coercing, or discriminating) against any individual who files a complaint under these laws or participates in a complaint investigation is prohibited. When a complaint is made, ESD 123 will take steps to stop further discrimination or harassment and prevent any retaliation against the person who made the complaint. Any individual alleging such harassment or intimidation may file a separate complaint with the Compliance Officer.
